Terms of Service

1. Acceptance & eligibility

These Terms of Service ("Terms") are a binding agreement between you and AIVORY COMPANY LIMITED ("we", "us") governing your use of the Mentation mobile app (the "App"). By using the App you accept these Terms and our Privacy Policy. You must be at least 13 years old to use the App; if you are under 18, you may use the App only with the consent of a parent or legal guardian, and only an adult may purchase a subscription.

2. The service

Mentation is a brain-training app offering cognitive measurement exercises, training games, and self-assessment tests, with progress tracking (baselines, charts, quests, streaks). Some content is free; a subscription unlocks the rest. Features, content, limits, and prices may change over time.

3. Accounts & Data Storage

  • You can use the app freely without an account ("Guest mode"). In Guest mode your data is stored only on your device: deleting or reinstalling the App, or losing your device, may permanently lose it, and we are not liable for such loss.
  • Sign-in is optional and is only prompted when you choose to save your data. Once signed in, all measurements, baselines, and progress are securely synced to our cloud servers.
  • Sign-in is via Sign in with Apple or Sign in with Google only. We do not collect a password; you may use Apple's "Hide My Email". You are responsible for your device, your sign-in provider account, and activity in the App.
  • A subscription requires a signed-in account. Delete Account in the App permanently deletes your entire account together with your measurement history, baselines, quests, and streaks (locally and on our servers), and this cannot be undone. You can also request account deletion by contacting us (see Privacy Policy).

4. Subscriptions, free trial, billing & cancellation

  • Mentation offers two auto-renewable subscription plans: Weekly and Annual. The price and billing period are shown in the App / App Store at the time of purchase and may vary by region, currency, promotion, and over time.
  • Weekly is charged immediately at purchase and renews every week. It includes no free trial.
  • Annual may include a 7-day free trial, available once per account, ever (including if you cancel during the trial). You are not charged during the trial; the annual price is charged automatically when the trial ends unless you cancel at least 24 hours before it ends. If you cancel during the trial you pay nothing and return to the free tier; your data is kept.
  • Payment is charged to your Apple ID at confirmation of purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period; your Apple ID is charged for renewal within 24 hours before period end.
  • Manage or cancel anytime in your Apple ID Settings → Subscriptions. Deleting the App does not cancel a subscription. Cancelling stops future renewals; you keep paid access until the end of the current period. You can restore purchases in the App after reinstalling or changing devices.
  • If a subscription expires or a renewal fails, your account returns to the free tier. Your data is not deleted — paid content is locked and unlocks again if you resubscribe.
  • Refunds are handled by Apple under the App Store terms; we generally cannot issue refunds directly.

5. License

We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

6. Acceptable use

You agree not to: misuse, reverse-engineer, scrape, or disrupt the App; share accounts or circumvent content locks, security, or subscription controls; use automated means to inflate scores, streaks, or quests; or use the App for any unlawful purpose.

7. Not a medical device — educational purposes only

❗ Mentation is not a medical device and is not medical, psychological, or professional advice. Exercises, games, and tests (including IQ-style, personality, chronotype, and career-interest tests) are self-assessments for educational and entertainment purposes only. They do not diagnose, treat, cure, or prevent any condition, and scores are not clinical measurements. We do not promise that using the App will improve your intelligence, memory, or any real-world ability. If you have concerns about your cognitive or mental health, consult a qualified professional.

8. Your data & sync

Signed-in results sync to our cloud servers; syncing requires a network connection and we do not guarantee it will be uninterrupted or error-free. You are responsible for the accuracy of information you provide during onboarding.

9. Third-party services

The App relies on third parties (Apple, Google/Firebase, Superwall). Your use may be subject to their terms, and we are not responsible for their services.

10. Intellectual property

The App, its content, exercises, and branding are owned by us or our licensors and protected by law. These Terms grant you no ownership rights. "16 Types" and other test names are ours or used descriptively; MBTI® is a trademark of its respective owner, with which we are not affiliated.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, SCORES, STREAKS, OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR USD 50 IF YOU PAID NOTHING).

13. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or violation of these Terms.

14. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time. Sections that by nature should survive (e.g. 10–13, 15) survive termination.

15. Changes

We may modify the App or these Terms. Material changes will be notified in-app or on https://aivoryvn.com. Continued use after changes means you accept the updated Terms.

16. Governing law & disputes

Nothing in these Terms limits any mandatory consumer-protection rights you have in your country of residence.

17. Apple App Store — additional terms

These Terms are between you and us only, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. To the extent permitted by law, Apple has no warranty obligation, and any claims relating to the App (product liability, legal/regulatory non-compliance, consumer protection) are our responsibility, not Apple's. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited-parties list, and you will comply with applicable third-party terms when using the App.
